1. Acceptance of Terms

These Terms of Use ("Terms") form a legally binding agreement between you ("User", "you") and ViralBlast ("we", "us", "our") governing your access to and use of the ViralBlast platform and all related services available at viralblast.app (the "Service"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 16 years old to use the Service. By using ViralBlast, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.

3. Account Registration

You must register for an account to access most features of the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@viralblast.app if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Billing

4.1 ViralBlast offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis as selected at checkout.

4.2 All fees are non-refundable except where required by applicable law or as stated in our Refund Policy.

4.3 We may change subscription pricing with at least 14 days' notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

4.4 Failure to pay may result in suspension or downgrade of your account.

5. Acceptable Use

You agree not to use the Service to:

Post, schedule, or publish content that is unlawful, defamatory, harassing, abusive, obscene, or that infringes any third-party intellectual property rights.

Spam, phish, or send unsolicited bulk messages through any connected social channel.

Violate the terms of service of any connected social media platform (Facebook, Instagram, TikTok, LinkedIn, X, YouTube, Pinterest, Reddit, Threads, WhatsApp Business, or others).

Attempt to gain unauthorized access to any part of the Service or any connected third-party system.

Use automated tools to scrape, crawl, or extract data from the Service beyond normal use.

Engage in any activity that disrupts, damages, or impairs the integrity or performance of the Service.

Use the Service to generate, distribute, or promote misinformation, hate speech, or content that promotes violence.

6. Social Media Platform Compliance

You are solely responsible for ensuring that all content you publish through ViralBlast complies with the terms, policies, and community guidelines of each connected social media platform. ViralBlast acts as a publishing tool on your behalf and is not responsible for platform enforcement actions, account suspensions, or content removals by third-party platforms.

7. Content Ownership and License

7.1 You retain all ownership rights to the content you create, upload, or publish using the Service ("Your Content").

7.2 By using the Service, you grant ViralBlast a limited, non-exclusive, royalty-free license to store, process, and transmit Your Content solely as necessary to provide the Service.

7.3 You represent and warrant that you own or have the necessary rights and permissions to use and publish Your Content, and that doing so does not infringe any third-party rights.

7.4 We do not claim ownership of Your Content and will not use it for any purpose beyond operating the Service.

8. Intellectual Property

All software, designs, trademarks, logos, and other materials comprising the ViralBlast platform are the exclusive property of ViralBlast or its licensors. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding without our prior written consent.

9. AI-Generated Content

ViralBlast provides AI-powered content generation tools. You acknowledge that:

AI-generated content is provided as a starting point and may require review and editing before publication.

You are solely responsible for reviewing, approving, and publishing any AI-generated content.

We do not guarantee the accuracy, originality, or suitability of AI-generated content.

AI tools must not be used to generate deceptive, harmful, or infringing content.

10. Third-Party Integrations

The Service connects to third-party platforms and services via APIs. We are not responsible for the availability, accuracy, or conduct of any third-party service. Your use of connected platforms is governed by those platforms' own terms and policies. We may add, modify, or remove integrations at any time.

11. Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable. We are not liable for any disruption or loss caused by downtime.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or that defects will be corrected.

13. Limitation of Liability

To the fullest extent permitted by applicable law, ViralBlast shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total cumulative liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless ViralBlast and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, Your Content, or your violation of these Terms.

15. Termination

Either party may terminate this agreement at any time. You may cancel your account via account settings. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use the Service ceases and we may delete your data in accordance with our Privacy Policy.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction in the territory where ViralBlast is registered.

17. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you by email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
